1. Acceptance of Terms

By accessing or using APEX360 ("the Platform"), you agree to be bound by these Terms & Conditions. If you do not agree, you may not use the Platform.

2. Description of Service

APEX360 provides a plant excellence assessment, diagnostics, and intelligence platform. We grant you a limited, non-exclusive, non-transferable license to use the Platform during your subscription period.

3. User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree not to use the Platform for any unlawful purpose.

4. Subscription & Billing

Subscription fees are billed in advance on a monthly or annual basis. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months.

5. Free Trial

We offer a 14-day free trial with full platform access. At the end of the trial period, your subscription will convert to a paid plan unless canceled. No credit card is required to start a trial.

6. Data & Privacy

We process your data in accordance with our Privacy Policy. You retain all ownership rights to your assessment data. We implement industry-standard security measures to protect your data.

7. Limitation of Liability

APEX360 is provided "as is" without warranty of any kind. We shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

8. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Platform will be revoked and your data will be exported or deleted per your request.

9. Changes to Terms

We reserve the right to modify these terms. Users will be notified of material changes via email or platform notification. Continued use constitutes acceptance of modified terms.

10. Governing Law

These terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved through binding arbitration.
